Electrical safety has been at the forefront of most Lettings Agents minds for many years now, with unclear directives as to what standard of electrical safety is proof enough to ensure that the property is electrically safe. Whilst most agents have deemed “the only way to know its safe is to have it tested by means of an EICR (Electrical Inspection Condition Report) its been challenging to enforce on Landlords who quite rightly point out, the law does not state this type of certification is required.
Last month, the topic of electrical safety inspections made headlines when the Government announced that it intends to press ahead with plans first announced last year to introduce regulations requiring landlords to undertake five yearly safety checks of electrical installations in their properties.
While no date has been announced for this, the Government has announced that it intends to introduce this new legislation on a phased basis, starting with new tenancies, as soon as Parliamentary time allows
There as been a gradual move towards mandatory safety checks with HMOs and Licensing stipulating a five yearly mandatory electrical installation safety checks for all private rented properties indicating that Mandatory checks for all Landlords will soon be inevitable.

With the Homes fit for Human Habitation Act coming into force on 20th March this year, and no clear guide on Electrical safety it becomes even more apparent that mandatory Electrical Certification is required. Dangerous electrics can contribute to a serious risk of fire, extreme cold, and insufficient lighting.
Even in the absence of a Mandatory check, Landlords who neglect Electrical Safety could therefore find enforcement notice taken against them and risk fines of up to £30,000.
